1. INTRODUCTION

Welcome to Ernith.

These Terms and Conditions (“Terms”) govern your access to and use of the Ernith website, applications, platform, products, services, courses, learning content, certifications, cybersecurity laboratories, artificial intelligence features, community services, career and hiring features, events and other offerings (collectively, the “Services”).

Ernith is operated by TriosCyber operating under the brand name Ernith (“Ernith”, “we”, “us”, “our”, or “Company”).

By accessing, registering for or using any Ernith Services, you confirm that you have read, understood and agree to be bound by these Terms and our applicable policies, including our Privacy Policy.

If you do not agree to these Terms, you must not use the Services.

2. ELIGIBILITY

You may use the Services only if you are legally permitted to enter into a binding agreement under applicable law.

If you are below the age of majority, you may use certain Services only with the involvement or consent of a parent or legal guardian where required by applicable law.

Certain Services may have additional eligibility requirements. Ernith reserves the right to refuse, restrict or terminate access where eligibility requirements are not met.

3. YOUR ERNITH ACCOUNT

To access certain Services, you may be required to create an account. You agree to:

• Provide accurate, complete and current information;
• Maintain and update your information when necessary;
• Keep your login credentials confidential;
• Not share your account with unauthorised persons;
• Notify Ernith promptly of suspected unauthorised access or security incidents;
• Accept responsibility for activities performed through your account, except where applicable law provides otherwise.

Ernith may suspend, restrict or terminate accounts that contain false information, are used fraudulently or violate these Terms.

4. ACCEPTABLE USE OF THE SERVICES

You agree to use Ernith lawfully and responsibly. You must not:

• Violate any applicable law, regulation or third-party right;
• Use the Services for illegal, fraudulent or harmful purposes;
• Attempt to gain unauthorised access to any system, account, network or data;
• Circumvent security controls or access restrictions;
• Upload malware, ransomware, viruses or other harmful code;
• Interfere with or disrupt the Services;
• Reverse engineer, copy, scrape or exploit the Services except where expressly permitted by law or written permission;
• Impersonate another person or organisation;
• Misrepresent your identity, qualifications, certifications or achievements;
• Harass, threaten, abuse or discriminate against other users;
• Use Ernith to distribute spam or unsolicited communications;
• Use automated systems, bots or scripts in a manner that negatively affects the Services;
• Collect another person's personal data without lawful authority;
• Use the platform to facilitate cybercrime or other unlawful activities.

Violation of this section may result in suspension or termination of access and, where appropriate, reporting to relevant authorities.

5. CYBERSECURITY LABS, TOOLS AND PRACTICAL ENVIRONMENTS

Ernith may provide cybersecurity training environments, simulations, laboratories, Capture The Flag (CTF) challenges, vulnerable applications, testing environments and other educational resources.

These Services are intended solely for authorised, educational and lawful purposes.

You agree that:

• You will perform testing only on systems, applications, networks or environments that you own or for which you have explicit authorisation;
• You will not use knowledge, tools or techniques obtained through Ernith to harm, exploit or gain unauthorised access to real-world systems;
• You will not use Ernith infrastructure for attacks against third parties;
• You will comply with the specific rules and scope of each lab, challenge or exercise;
• You will not intentionally disrupt shared learning environments or interfere with other users.

Ernith may monitor activity within its authorised training environments for security, abuse prevention and platform integrity.

Nothing provided by Ernith constitutes authorisation to test, scan, exploit or access any third-party system. Users remain solely responsible for ensuring that their cybersecurity activities are properly authorised and lawful.

6. AI-POWERED FEATURES

Ernith may provide artificial intelligence (“AI”) powered features. When using AI features, you acknowledge that:

• AI-generated content may be inaccurate, incomplete or outdated;
• AI responses may contain errors;
• AI outputs should be independently reviewed before being relied upon;
• AI outputs do not constitute professional legal, medical, financial or other regulated professional advice;
• You must not submit unlawful, confidential or highly sensitive information unless you have the necessary authority and it is appropriate to do so;
• You remain responsible for how you use AI-generated outputs.

You must not use AI features to generate or facilitate unlawful activity, harm or harass individuals, conduct fraud, generate malicious content, or circumvent security controls.

7. COURSES, LEARNING CONTENT AND EDUCATIONAL SERVICES

Ernith may provide courses, learning modules, workshops, training programs, assessments, live sessions, recorded sessions, practical exercises, learning resources, mentorship, certifications and other educational Services.

Unless expressly stated otherwise, access to educational content is personal and non-transferable. You must not share paid content with unauthorised persons, record or commercially exploit content without permission, or sell learning materials.

8. ASSESSMENTS, EXAMINATIONS AND CERTIFICATIONS

Certain programs may include examinations, assessments or certifications. Users must maintain academic and professional integrity. You must not cheat, use unauthorised assistance, impersonate candidates, or falsify certificates.

Ernith reserves the right to invalidate assessments, cancel or revoke certificates, and suspend or terminate accounts where misconduct is established.

9. CAREER, JOB AND INTERNSHIP FEATURES

Ernith may provide career-related features including job listings, internship opportunities, employer connections, talent discovery, and resume tools.

Ernith does not guarantee employment, internships, interviews, selection, salary, or placement outcomes. Employers are responsible for their own listings and recruitment decisions.

10. PAYMENTS AND PAID SERVICES

Certain Ernith Services may require payment. Before completing a purchase, applicable pricing, billing terms and conditions will be presented. You agree to provide accurate payment and billing information. Payments may be processed through authorised third-party payment providers (e.g. Razorpay).

11. INTELLECTUAL PROPERTY

The Ernith name, logo, branding, software, platform design, content, course materials, videos, graphics, text, assessments, certificates, databases and other intellectual property are owned by or licensed to Ernith/TriosCyber.

12. USER CONTENT

You retain ownership of content you own (profiles, resumes, assignments, comments, documents). By submitting content, you grant Ernith a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process and display that content solely as reasonably necessary to operate the Services.

13. COMMUNITY CONDUCT

Where Ernith provides communities, forums or collaborative spaces, users must maintain a professional and respectful environment.

14. THIRD-PARTY SERVICES AND CONTENT

Ernith may integrate with or link to third-party websites, services, tools, employers, institutions or other providers. Third parties are responsible for their own content, privacy practices, and terms.

15. AVAILABILITY AND MODIFICATION OF SERVICES

We aim to provide reliable Services, but we do not guarantee uninterrupted or error-free operation. Ernith may update the platform, modify features, perform maintenance, or restrict access for security reasons.

16. PRIVACY AND DATA PROTECTION

Our collection and processing of personal data are described in our Privacy Policy. By using Ernith, you acknowledge that personal data may be processed in accordance with applicable law.

17. SUSPENSION AND TERMINATION

Ernith may suspend, restrict or terminate access where we reasonably believe that Terms have been violated, Services are used unlawfully, or security risks exist.

18. DISCLAIMER OF WARRANTIES

The Services are provided on an “as available” basis, subject to applicable law.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Ernith, TriosCyber, and its directors, employees, partners and service providers will not be liable for indirect, incidental, special, consequential or punitive losses.

20. INDEMNITY

You agree to indemnify and hold Ernith harmless from claims, losses, liabilities and reasonable expenses arising from your unlawful use of the Services or violation of these Terms.

21. CHANGES TO THESE TERMS

Ernith may update these Terms from time to time. Your continued use of the Services after updated Terms become effective constitutes acceptance.

24. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and service-specific policies, constitute the entire agreement between you and Ernith regarding your use of the Services.
